“The English High Court was recently asked to rule on whether a Limitation fund in England could be constituted by way of an International Group P&I Club Letter of Undertaking (“Club LOU”). The Court of Appeal has now confirmed that owners are entitled to constitute a limitation fund by producing a guarantee in the form of a Club LOU.”
