Spain: Review of changes – Ports Law 48/2003

Independent Correspondents & Maritime and Transport Services S.L., Barcelona, have provided us with the following information.

We are pleased to enclose our Circular 1A/2005 of 20th January referred to “Spain: Ports Law 48/2003 modifying the previous Ports Law 27/1992: review after its one year application”, where we inform about the most relevant changes of interest to shipowners and operators.

These changes are: port taxes; detention of vessels; when vessels can be understood to be abandoned and sold at public action; detained vessels by a public authority which represent a potential danger to people or property or cause problems to the port activity and can be therefore sold at public auction or sank; and, ship agents’ liability in cargo claims.
